Agreement to Terms

By accessing or using Updatest, you agree to be bound by these Terms and Conditions. If you do not agree, you may not use the app.

License

When you purchase a license for Updatest, you are granted a non-exclusive, non-transferable license to use the software for personal or internal business use on your own devices. Redistribution, sublicensing, or resale is strictly prohibited.

Free Trial

We offer a 14-day free trial of Updatest. No payment is required to start the trial. After the trial expires, access to the app will be disabled unless a license is purchased. There is no automatic billing or conversion to a paid plan.

Each user is eligible for one free trial. To continue using Updatest after the trial, a license must be purchased manually through our website.

Trial Abuse

The 14-day free trial is intended for evaluation purposes only and is limited to one trial per user or organization. Any attempt to circumvent this limitation — including but not limited to creating multiple accounts, using disposable email addresses, or manipulating system files — is strictly prohibited and may result in termination of access to Updatest.

Refund Policy

We offer a 30-day refund policy on all paid licenses. If you're not satisfied with Updatest, contact us at help@updatest.app within 30 days of purchase and we'll issue a full refund. Refunds will not be issued after 30 days.

Prohibited Uses

You agree not to use Updatest for any unlawful or harmful purpose, or in any way that may disrupt the app or services. You may not attempt to reverse-engineer, decompile, or bypass any technical restrictions in the software.

Updatest Network Disclaimer

The Updatest Network is an optional feature provided for informational purposes only.

The Updatest Network relies on version information reported by other users and does not guarantee accuracy, completeness, timeliness, or correctness. Reported versions may be delayed, incomplete, outdated, or reflect limited distributions such as staged rollouts, beta releases, region-specific versions, or enterprise deployments.

Updatest does not verify, validate, or independently confirm network-reported version information. The Updatest Network should not be relied upon as an authoritative source of update availability.

Updatest does not provide download links, update actions, or installation mechanisms for network-discovered updates. Any updates shown through the Updatest Network must be installed manually by opening the application or visiting the developer's website.

You acknowledge and agree that you use the Updatest Network at your own discretion and risk. Updatest and its developers are not responsible for any decisions made, actions taken, or outcomes resulting from reliance on network-reported update information.

Resale Prohibited

You may not resell, distribute, or sublicense Updatest without our written permission.

Limitation of Liability

To the fullest extent permitted by law, Updatest and its developer shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of data, loss of profits, loss of business opportunities, system failure, or personal injury, arising out of or in connection with your use of the app, whether based in contract, tort, strict liability, or otherwise.

Updatest is provided "as is" and without warranties of any kind. We do not guarantee that the app will be uninterrupted, error-free, secure, or meet your specific requirements. You use the app at your own risk.

Our total liability for any claim arising out of or relating to these terms or the use of Updatest shall not exceed the amount you paid (if any) for your license to use the app. If you are dissatisfied with any part of the app, your sole and exclusive remedy is to stop using it.

You agree to indemnify and hold harmless the developer of Updatest from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your violation of these terms or your use of the app.

Updatest may integrate with or rely on third-party services (such as Homebrew, Sparkle, or others). We are not responsible for the availability, accuracy, or performance of these third-party services and disclaim all liability arising from their use or failure. This includes, without limitation, inaccuracies or omissions in optional features such as Community Updates.

We make no guarantee of ongoing support, feature availability, or future updates. Features may be modified or removed at any time without notice.

Some jurisdictions do not allow the exclusion or limitation of liability for certain types of damages. In such cases, our liability shall be limited to the maximum extent permitted by applicable law.

These terms are governed by the laws of the Province of Manitoba, Canada, and the federal laws of Canada applicable therein. This limitation of liability section shall survive the termination or expiration of these terms.

Disclaimer of Warranties

Updatest is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the app will be uninterrupted or error-free, or that it will meet your specific requirements.

You assume full responsibility for any consequences resulting from the use of the app.

Termination

We reserve the right to suspend or terminate your license and access to Updatest at any time if you violate these Terms. Upon termination, you must cease all use of the app and destroy any copies in your possession.

Intellectual Property

Updatest, including all code, design, logos, and documentation, is the intellectual property of its developers. You may not use our name, branding, or assets without written permission.

Governing Law

These Terms are governed by the laws of the Province of Manitoba, Canada. Any disputes will be resolved in accordance with Manitoba law.

Privacy

Please review our Privacy Policy to understand how we collect and use your information.

Modifications

We may update these Terms from time to time. If we make significant changes, we will notify users via the app or our website. Continued use after changes implies acceptance of the updated Terms.
